1. Introduction
This Terms of Service ("Agreement") outlines the terms and conditions under which I provide web development services. By engaging my services, you agree to the terms outlined below.
By contacting me via any method (email, contact form, Facebook, Instagram, video call or any other communication channel), you acknowledge that these Terms of Service apply. Any agreements or exceptions must be explicitly confirmed in writing, and verbal discussions do not override the terms outlined here.
Preferred Communication Method:
- All official notices, updates, requests, and deliverables must be handled through email.
- While I may respond to social media messages (e.g., Instagram DMs or Facebook Messenger), I cannot guarantee message delivery or timely replies through those platforms.
If I need to send you important updates—such as changes to your domain, backend access, or billing responsibilities—I will notify you via email. In some cases, I may also follow up using a secondary method (e.g., DM or text), but email is considered the official and primary method of communication.
2. Services Provided
I specialize in creating professional, modern, and responsive websites. My services include:
- Business websites for small and local businesses
- Landing pages for marketing and lead generation
- Website redesigns and improvements
- SEO-friendly and fast-loading designs
- Basic integrations (contact forms, Google Maps, etc.)
What I Do Not Provide:
- Heavy backend development (custom CMS, complex databases, etc.)
- Mobile app development
- Large-scale e-commerce platforms with advanced features
- AI, blockchain, or game development
- Enterprise-level corporate systems
3. Payment Terms
To begin work, a 50% upfront deposit is required. The remaining 50% is due upon completion of the website before final delivery.
Refund Policy:
- The upfront deposit is non-refundable once work has begun.
- Refunds will only be provided in cases where no work has been started.
- Even if payment is delivered, I will refuse to create a website if it contradicts Section 6. A refund may be possible.
Payment Methods:
Payments will be received via Bank Transfer.
4. Domain, Hosting, and Database Control
I will handle front-end development and assist with platform integrations as needed.
For platforms such as Supabase, Stripe, Firebase, or Google Cloud, the client is responsible for creating their own account and project, unless otherwise agreed in writing.
The client must:
- Create their own account
- Create the relevant project (e.g., Supabase project)
- Invite me as a collaborator with full access
I will guide the client through this process as needed. The client may remove my access at any time after project completion.
This process ensures the client retains full ownership and billing control of critical infrastructure.
5. Liability Disclaimer
- I am not responsible for any issues arising from third-party services (e.g., hosting downtime, API failures).
- Security and maintenance are the client's responsibility, as I do not provide ongoing maintenance services.
- I am not liable for lost revenue or damages resulting from website issues post-launch.
- I am not responsible for any bugs, errors, or third-party issues that happen after the website is completed and published. Any fixes or change requests after launch will require additional payment.
6. Rejected Content
I reserve the right to refuse projects involving:
- Illegal activities or content
- Adult content
- Gambling or betting services
- Content promoting hate speech or discrimination
- Any content deemed unethical or harmful
7. Domain & Hosting Process
To ensure a smooth deployment process:
Domain Selection & Ownership
I will research and suggest three available domain options under $25. The client selects one, and I may cover the cost and register the domain under my own account.
However, I reserve the right to stop paying for the domain at any time, regardless of cost, including if it's under $25.
If I decide to stop renewing a domain:
- I will provide notice via email and at least one additional method (e.g., text, social media message, or in-app notification if available).
- I will not intentionally shut down the domain or associated website without notifying the client first.
- If no response is received within 14 days of initial notice, I cannot guarantee continued service, renewal, or recovery of the domain.
Clients may also choose to manage their domain and hosting independently. If I handle setup, transfers are not guaranteed unless agreed upon before work begins.
8. Revisions & Change Requests
- I offer unlimited revisions until the client is happy with the final result.
- Once the client confirms satisfaction and the website is fully completed and published, no further revisions will be included.
- Any future changes or modifications after this point will require an additional fixed payment.
- Any bugs, errors, or content issues after launch also require extra payment to fix.
9. Admin Dashboard (Optional)
Clients can purchase an optional admin dashboard to make basic updates to the website. This includes changes like:
- Updating text and headings
- Swapping images
- Adding or removing simple items (e.g., services, products, FAQs)
The dashboard does not allow advanced changes such as layout redesigns, feature upgrades, SEO optimization, analytics setup, or styling updates.
These advanced changes must be requested and paid for separately.
10. No Guarantees on Results
- I do not guarantee increased traffic, conversions, or sales as a result of the website.
- SEO and performance optimization are included, but results may vary depending on market conditions, competition, and external factors.
11. Indemnification
- The client agrees to indemnify and hold me harmless from any legal claims, damages, or liabilities resulting from the content they provide or any business activities conducted via the website.
- I am not responsible for legal compliance (e.g., privacy policies, accessibility laws, GDPR compliance); the client must ensure their website follows relevant regulations.
12. Project Delays & Abandonment
- If the client fails to provide required materials (content, images, feedback) within 14 days, the project may be put on hold.
- The project will be deleted after 30 days of inactivity.
- If the client wishes to continue after deletion, they will still need to pay 50% again (the original 50% remains non-refundable).
13. Trust & Privacy Commitment
- I value privacy and security and take responsibility for handling setup professionally.
- I will never tamper with client data, domains, or databases outside of agreed-upon work.
- All hosting, database, and domain infrastructure will be handled under my accounts unless agreed otherwise from the start.
- Clients are encouraged to keep backups of any provided content and update their own passwords (e.g., Stripe, PayPal) after setup for added security.
By engaging my services, you acknowledge that you have read, understood, and agreed to these terms.
